HB 157 (2016) -  Sentencing in Capital Felonies

Requires that advisory sentence of death be made by unanimous recommendation of jury; requires court to instruct jury that in order for jury to recommend death penalty, jury must find that sufficient aggravating circumstances exist which outweigh mitigating circumstances & that each aggravating circumstance must be proven beyond reasonable doubt by unanimous vote; requires that court provide special verdict form specifying each aggravating circumstance found; limits court's findings concerning aggravating circumstances to those found by jury.
