General Bill by Health & Human Services Committee and Health & Human Services Access Subcommittee and Harrell
Vulnerable Children and Adults: Authorizes certified homeless youth or minor who has had disabilities of nonage removed to obtain birth certificate; prohibits monitoring requirements that mandate pornographic materials be available in residential facilities that serve APD clients; requires court to order person involuntarily admitted to residential services to be released to agency for appropriate residential services; prohibits court from ordering that such person be released directly to residential service provider; authorizes agency to transfer person from one residential setting to another; requires agency to notify committing court & person's counsel of transfer within specified time; authorizes agency to issue final order; decreases limits of liability and requisite insurance coverage for lead community-based providers & subcontractors; provides immunity from liability for DCFS for acts or omissions of community-based provider or subcontractor, or officers, agents, or employees thereof; requires sufficient community-based placements for defendants charged with sex offenses; requires that court order person involuntarily admitted to residential services after criminal charges have been dismissed to be released to agency for appropriate residential services; creates task force to develop input for creation of certain guidelines & procedures for providers of residential services; requires agency to provide administrative support to task force; requires report to Legislature.
